Dubai Property Management: Compliance Guide for Owners

Management Is More Than Collecting Rent

Property management should protect the asset, document income and expenses, support lawful tenancy administration and give the owner a clear audit trail. Overseas ownership does not remove the need to comply with Dubai’s rental, registration and jointly owned property requirements.

Before appointing a manager, verify the company’s relevant real-estate activity through official DLD channels and sign a written management agreement defining its authority and responsibilities.

What the Management Agreement Should Cover

  • the exact property and scope of authority;
  • marketing, tenant screening, viewing and leasing responsibilities;
  • Ejari registration and renewal responsibilities;
  • rent collection, approved payment methods and owner remittance timing;
  • maintenance approval limits, emergency authority and contractor selection;
  • inspection, inventory and handover records;
  • management, leasing and other fees, including VAT where applicable;
  • handling of deposits and supporting records;
  • complaints, notices, disputes and legal-instruction limits;
  • reporting frequency, document retention, data protection, termination and handover.

Commercial management fees vary. The site should quote them only from the signed proposal or contract, not as a universal percentage.

Tenancy and Rent Administration

  • Ejari: ensure the tenancy contract and its status are handled through the approved DLD/Ejari process.
  • Rent increases: check the current DLD Rental Index and the applicable notice requirements for the relevant renewal. DLD states that an increase supported by the index will not apply where the landlord failed to notify the tenant at least 90 days before expiry.
  • Security deposit: record the agreed amount, condition evidence, lawful deductions and return process. The previous site claim of universal 5% and 10% statutory caps has been removed because it was not supported by the reviewed official source.
  • Payment records: retain the contract, Ejari certificate, receipts, cheque or transfer records, correspondence and notices.

Maintenance Responsibilities

DLD’s current FAQ distinguishes between:

  • required maintenance that directly affects the tenant’s full enjoyment of the property, which DLD describes as the landlord’s responsibility; and
  • non-essential maintenance, which DLD describes as typically the tenant’s responsibility.

The tenancy contract, the nature of the defect and the applicable law still matter. Managers should document reports, approvals, contractor work, invoices and before-and-after evidence rather than relying on informal messages.

Eviction and Disputes Require Exact Procedure

Dubai tenancy termination and eviction depend on the legal ground, timing and prescribed notice procedure. DLD’s FAQ states that eviction sought for personal or first-degree-relative use, sale or certain other post-expiry grounds requires a notice stating the reason through a notary public or registered mail, with at least 12 months between notification and the requested eviction date.

Other breaches and termination grounds have different requirements. Owners and managers should not use a generic eviction template or promise an outcome. Obtain appropriate legal guidance and use the Rental Disputes Center where a dispute requires formal resolution.

Service Charges and Building Oversight

DLD states that service and maintenance charges differ by project and that management entities should not demand service charges before RERA approval. Use the DLD Service Charge Index for the specific project, use and year, and retain the approved budget and payment evidence.

DLD’s FAQ identifies the owner as responsible for the property’s service charges, while tenant utility, municipality and cooling arrangements can differ. The lease and provider documents should state the practical allocation clearly without re-labelling owner service charges as tenant obligations.

Minimum Owner Reporting

  • rent received, arrears and upcoming payment dates;
  • occupancy, renewal and notice calendar;
  • income-and-expense statement with supporting documents;
  • maintenance log, open work orders and warranties;
  • service-charge status and building notices;
  • deposit ledger and tenant correspondence;
  • inspection reports and photographs; and
  • expiry dates for contracts, insurance and delegated authority.

A manager’s report should separate facts, estimates and recommendations so the owner can make an informed decision.
